Settle a rental dispute at Dubai's Rental Dispute Settlement Centre

Important Update: Dubai's Rental Dispute Settlement Centre located at Dubai Land Department has replaced the earlier Dubai Muncipality Rent Committee effective from 17/11/2013.

If either tenant or landlord has a dispute over rent, which cannot be negotiated themselves, the legal option is to bring the case to RDSC. HH Sheikh Mohammed Bin Rashid Al Maktoum, in his capacity as Ruler of Dubai has established the RDSC through Decree No. 26 for 2013. RDSC based at Dubai's Land Department replaces the earlier Dubai Municipality Rent Committee for rental disputes in Dubai. RDSC is is authorized by Dubai Government to provide a judicial sytem that can deal with rental disputes and settle legal issues in a quick, transparent and professional manner.

RDSC promises simplified procedures with most rental disputes being judged within 75 days. The Centre will handle most rental disputes for the Emirate of Dubai including Dubai free zones, unless such disputes have been assigned to special judicial committees or courts. Also RDSC will not look into rent disputes arising from finance lease contracts or long-term lease contracts covered by the provisions of Law No. 7 of 2006 for real estate registration in Dubai.
RDSC includes four departments: Arbitration & Reconciliation Department, Department of First Instance, Department of Appeal and Law Enforcement Department.
First the Arbitration Department will try to settle disputes amicably within 15 days. If not successful, a lawsuit has to be lodged with the Department of First Instance, which will try to settle the dispute within 30 days with rulings final unless appealed to the Department of Appeal, and only for claims worth more than AED 100,000; and issue a verdict within 30 days.

 

RDSC Fees & Documents

Plaintiff to pay 3.5% of annual rent with a minimum of AED 350 and a maximum ceiling of AED 20,000
Other fees may be levied by RDSC on plaintiff for summoning experts, payment of expert’s fee, fee for deposit of rent with RDSC etc

You may have to separately pay for a newspaper advertisement in a local newspaper, in case the defendant fails to show up for a committee hearing.
 
The plaintiff will also need to submit:
Plaintiff name with designation (either lessor, lessee, landlord or occupant) with current address

The facts of the dispute
Original tenancy contract
Notarized PoA (Power of Attorney) in favour of person authorized to represent the plaintiff
Copies of cheques, if any, that were submitted to the landlord.
(Note:For plaintiffs who are tenants, but cannot submit the original tenancy contract with the new rent terms, due to refusal from the landlord; you can fax a request to the landlord and submit the fax receipt as proof to RDSC.)
